MEO Complaint Received
Rapid-response playbook for a Military Equal Opportunity report reaching the command. Sorts the confidential report from the informal complaint, the formal complaint, and the anonymous allegation. Carries the five deadlines in MARADMIN 380/26, the eight dismissal grounds, the appeal to the next GCMCA, and the 7-day restart on delayed favorable personnel actions.

Log the date of receipt in writing the day the complaint reaches you. Every deadline below keys off a date someone will ask you to prove.

Dismissal Without Investigation
You hold the authority to dismiss a formal MEO complaint without investigation. Consult the command Equal Opportunity Advisor and the staff judge advocate first. Both consultations are required by paragraph 5.a, not optional staffing.
Eight grounds, and no others.
- Untimely. Filed more than 60 calendar days after the most recent incident. 120 calendar days for a Reserve member.
- The allegation falls outside the scope of MEO policy.
- The complaint lacks sufficient or actionable information.
- Alternative dispute resolution or other informal means resolved the matter.
- The complainant requests withdrawal.
- The complainant fails to respond to requests for information.
- The complaint duplicates another.
- The complaint constitutes a false official statement under Article 107, UCMJ.
Ground one is a ground for dismissal, not an automatic bar. A late complaint still reaches you and still requires the consultation and the written decision.
Ground eight names an Article 107 exposure. Naming it is not a charging decision. Route any false official statement question to your SJA before it touches the dismissal memo.
Appeals
The complainant appeals your dismissal to the next higher commander holding General Court-Martial Convening Authority, within 5 calendar days of your written determination. This is an appellate role your GCMCA holds outside the UCMJ referral chain. Paragraph 6.b puts the detailed appeal procedure into the next revision of MCO 5354.1, so expect the mechanics to firm up in the H revision.
State the appeal right and the deadline inside the written notice. A complainant learning about the route after the window closes has a legitimate grievance against your process, not against the outcome.
Favorable Personnel Actions
Paragraph 7 gives you 7 calendar days to resume or complete any favorable personnel action delayed by the complaint, counted from dismissal or from an unsubstantiated finding. Promotion, orders, awards, schools, and reenlistment all sit in this category.
Pull the list of delayed actions on the day you make the determination. Waiting for the S-1 to notice costs the Marine time you already owe back.
What You Do Not Do
- Do not investigate a confidential report. Three exceptions release it and nothing else.
- Do not process an anonymous allegation of discrimination as an MEO complaint. Act on the information through another authority instead.
- Do not treat the MEO program as an investigative body. MARADMIN 357/26MARADMIN 357/26 states plainly it is non-investigative and not the lead for misconduct outside its scope.
- Do not force conflict resolution. Participation is voluntary for both parties under paragraph 4.c.
- Do not dismiss without both the EOA and the SJA consultation on the record.
Common Failure Modes
- Confidential read as anonymous. The two arrive in adjacent paragraphs with opposite effects. Confidential preserves the Marine's identity for authorized personnel and preserves the right to convert. Anonymous produces no complaint at all.
- The 30-day clock started at the wrong desk. Log the EOA receipt date and the command receipt date separately.
- Written notice issued without the appeal route. The complainant loses a 5-day window they never learned about.
- Favorable actions left in limbo after an unsubstantiated finding. The 7-day restart applies to unsubstantiated findings, not to dismissals alone.
- Conflict resolution treated as a gate. A complainant declining conflict resolution moves straight into the complaint process under paragraph 4.b.
