MCBUL 5810 - Criminal Justice Information System (CJIS) Reporting Requirements

Scope

MCBUL 5810 of 22 May 2024 sets Marine Corps Criminal Justice Information System (CJIS) reporting requirements. The bulletin requires commanding officers to provide supporting documentation and direct designated members to report to the servicing law enforcement agency (NCIS, CID, PMO, or other) within 5 working days for specific dispositions. Audience

Commanding officers across the Marine Corps. S-1 officers and legal clerks processing CJIS reports. Servicing law enforcement agencies (NCIS, CID, PMO).

Reporting categories

Per Enclosure 2, the following dispositions trigger CJIS reporting within 5 working days:

• Civilian court-issued restraining order against a unit member.
• SPCM, GCM, or civilian court conviction of a crime of domestic violence.
• NJP, SCM, SPCM, or Admin Separation finding of wrongful use of a controlled substance under Article 112a, UCMJ.
• Charges referred to a GCM.
• GCM conviction of any offense punishable by more than 1 year confinement.
• GCM domestic violence finding under the bulletin's definition.
• Finding of incompetence to stand trial or not guilty by reason of lack of mental responsibility at SPCM or GCM.
• UA or deserter status following preferral of charges.

Prohibited person duties

Enclosure 2 requires the commanding officer to counsel in writing a "prohibited person" to abide by federal law restricting access to personally owned firearms and ammunition under 18 U.S.C. 922(g). The unit implements an armory access control procedure ensuring prohibited persons do not access privately owned firearms stored in unit armories.
