Common pitfalls
- UPB completed with missing blocks. Per Volume 14 paragraph 011105, every block (Items 1-22) completes per the rule. Missing Item 2 Article 31 acknowledgment, Item 8 commander identification, or Item 22 victim demographic entry triggers IGMC finding.
- UPB filed outside the 3-year retention. Per Volume 14 paragraph 011110.A and B and SECNAV M 5210.1, the UPB retains alphabetically for 3 full years in loose-leaf or electronic format.
- NJP run without legal sufficiency review. Per Volume 12 and Volume 14, route through legal before the commander signs the imposition block. A defective NJP voids on appeal.
- Court-martial Initial Review Officer skipped. Per Volume 16 Chapter 7 and Rule for Courts-Martial 305, pretrial confinement requires Initial Review by a neutral and detached officer within 7 days. Skipping breaks the confinement.
- Victim NJP notification skipped. Per Volume 16 Chapter 4 paragraph 040401.Y, the victim receives notification of NJP disposition decision, time and location, and findings and sentence imposed.
- Administrative Investigation past time limits without explanation. Per JAGINST 5800.7G Chapter II sections 0203e, 0206c(9), 0209f, 0210c(7), 0210f(1), and 0225e, the IO and commander complete on time or carry an explanation in the endorsement.
- MCBUL 5810 criminal justice report past 5 working days. Per MCBUL 5810 enclosure 2, the report runs within 5 working days of disposition or notification.
- Legal file folder labeled without SSIC, dates, and disposal instructions. Per SECNAV M-5210.2 Part I Chapter 2 paragraph 2-2, every folder carries the SSIC, open/close dates, and disposal instructions on the outside.
- Officer NJP filed without MARADMIN 427/23 routing. Per MARADMIN 427/23, the officer NJP UPB entry, acknowledgment of opportunity to submit matters, and any response routes to IPAC for OMPF inclusion.
Decision points
- NJP versus court-martial. Per Volume 16 Chapter 6 and Manual for Courts-Martial Part V, the convening authority decides based on seriousness, severity, and the accused's rights election. The accused holds the right to demand trial by court-martial in lieu of NJP for non-aboard-ship members.
- Administrative versus punitive discharge. Per MCO 1900.16 and the Manual for Courts-Martial, administrative separation runs under Chapter 6 (enlisted) or Chapter 4 (officer). Punitive discharge flows from a court-martial sentence.
- Command Investigation versus Litigation-Report Investigation. Per JAGINST 5800.7G Chapter II sections 0206 and 0210, Command Investigation runs the standard administrative inquiry. Litigation-Report Investigation runs in contemplation of litigation and protects attorney work product.
- Pretrial confinement versus restriction. Per Volume 16 Chapter 7 and Rule for Courts-Martial 304-305, confinement requires probable cause, flight risk or serious offense risk, and a 7-day Initial Review. Restriction is the less restrictive alternative.
- Officer resignation in lieu of trial. Per Volume 15, an officer facing court-martial offers resignation in lieu of court-martial. The Secretary of the Navy approves.
